1. Agreement and eligibility
These Terms of Use (“Terms” or “Agreement”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Random Hit LLP, doing business as Wake Wake (“Wake Wake,” “we,” “us,” or “our”).
By downloading, installing, purchasing, or using the Wake Wake iOS application, website, or associated services (the “Services”), you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use the Services.
You must be at least 13 years of age (or the age of majority in your jurisdiction) to enter into this Agreement. If you are under the age of majority, a parent or legal guardian must review and agree to these Terms on your behalf.
2. Description of Services
Wake Wake is an iOS morning alarm and routine application designed to encourage prompt waking through interactive challenges, including real-time movement verification (push-ups, squats), cognitive puzzles (math, memory lock), and habit tasks (daylight check, bed making), along with streak and milestone tracking.
We may update, enhance, or modify features from time to time. Current functionality is described on our Services page and the official App Store product listing.
3. In-App Purchases, Subscriptions & 3-Day Free Trial
Wake Wake offers optional auto-renewing subscription plans to unlock premium features, unlimited alarms, and all movement/brain challenges:
- Monthly Subscription: $7.99 per month, charged to your Apple ID on a recurring monthly basis until canceled.
- Annual Subscription: $24.99 per year, charged to your Apple ID on a recurring annual basis. Includes a 3-day free trial for eligible new subscribers.
- Free Trial Terms: If offered, the 3-day free trial begins upon purchase confirmation in the App Store. If you do not cancel at least 24 hours prior to the conclusion of the 3-day period, your Apple ID will automatically be billed $24.99 for an annual subscription.
- Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
- Renewal Charges: Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period ($7.99 for monthly or $24.99 for annual).
- Subscription Management: You can manage your subscriptions and turn off auto-renewal at any time by going to your iPhone Settings → [Your Name] → Subscriptions, or via Apple Subscriptions Portal.
- Forfeiture of Unused Trial: Any unused portion of a free trial period, if offered, will be forfeited when purchasing a subscription, where applicable.
4. Refunds and cancellations
All billing, transactions, payments, and refunds are processed exclusively by Apple Inc. under Apple's Media Services Terms and Conditions. Random Hit LLP does not process credit cards or retain billing records.
If you wish to request a refund for an App Store charge or subscription, please submit your claim directly to Apple at reportaproblem.apple.com. For detailed instructions, please read our dedicated Apple Refund Policy.
5. Movement challenges, physical safety & health disclaimer
Certain challenges in Wake Wake require physical movement (such as push-ups or squats). You are solely responsible for ensuring that your physical condition, clothing, and environment are safe for exercise.
Non-movement cognitive challenges (Mental Math, Number Lock, Standard Mode) are provided for users who prefer or require non-physical waking methods.
6. Alarm delivery and critical reminders
Alarm sound and notification delivery rely on device settings outside our complete control, including iOS permissions, volume settings, Focus / Do Not Disturb modes, battery levels, and operating system updates.
Do NOT use Wake Wake as your sole alert for medical emergencies, time-critical medication, flight departures, life-safety obligations, or vital legal deadlines. Always maintain an independent secondary alarm for mission-critical events.
7. Device permissions and camera privacy
Camera access is requested solely for Wake Task verification. Camera frames for Wake Tasks (squats, push-ups, find-the-sky, make-the-bed) are downscaled on your device and sent to our server, and on to OpenAI, for one-time automated verification. They are processed in memory and are never stored — not by us, and not retained by OpenAI beyond its standard short-term abuse monitoring. Math and Number Lock require no camera at all. 8. Accounts, data deletion, and termination
You may stop using the Services at any time. You may request complete account and data deletion in-app (Settings → Delete Account) or by emailing support@randomhit.site. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.
9. Acceptable use and intellectual property
All software, UI design, graphics, trademarks, and code comprising Wake Wake are the exclusive property of Random Hit LLP and its licensors. You may not reverse engineer, decompile, resell, or distribute the Services except as permitted by mandatory law.
10. Apple App Store specific terms
You and Random Hit LLP acknowledge and agree that:
- This Agreement is concluded between you and Random Hit LLP only, and not with Apple Inc. Random Hit LLP, not Apple, is solely responsible for the Wake Wake application and its content.
- Apple has no obligation whatsoever to furnish any maintenance and support services with respect to Wake Wake.
- In the event of any failure of Wake Wake to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for Wake Wake to you; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Wake Wake.
- Random Hit LLP, not Apple, is responsible for addressing any claims by you or any third party relating to Wake Wake, including product liability claims, legal or regulatory compliance claims, and consumer protection claims.
- In the event of any third-party claim that Wake Wake infringes a third party’s intellectual property rights, Random Hit LLP, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
- You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties.
11. Disclaimer of warranties and limitation of liability
To the maximum extent permitted by applicable law, the Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied.
To the extent permitted by law, Random Hit LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or personal injury resulting from your use of the Services. In no event shall Random Hit LLP's aggregate liability exceed the greater of the amount you paid to Random Hit LLP in the past twelve (12) months or US$50.00.
12. Governing law and dispute resolution
These Terms are governed by the laws of India, without regard to conflict of law principles. Any dispute arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in Sri Ganganagar, Rajasthan, India. Non-waivable consumer statutory rights in your country of residence remain fully preserved.
